Cloudinary Acceptable Use Policy

This Acceptable Use Policy (“AUP”) forms part of the Terms of Use or other agreements governing the use of Cloudinary’s Services (the “Terms”). It outlines the activities prohibited in connection with your use of Cloudinary’s Services and/or any of Cloudinary’s websites (collectively, the “Services”). This AUP applies to all activities performed through the account you registered to use the Services (“Account”).

Above all, our priority is to maintain a professional, safe, and productive environment for all customers and users of our services and platform. Adherence to this AUP is essential for us to fulfill that commitment.

      1. Prohibited Activities

      As a condition for using the Services, you represent and warrant that you will not, and will not permit any third party to:

    • 1.1 Use the Services for any illegal, unlawful, fraudulent, or deceptive activities, or for competitive purposes;
    • 1.2 Impersonate any person, organization, or entity, or falsely represent your affiliation with any person, organization, or entity;
    • 1.3 Violate the privacy of others through the Services, including posting private or confidential information without authorization;
    • 1.4 Engage in or promote defamatory, libelous, threatening, harassing, or stalking behavior, including hate speech.
    • 2. Security Obligations

      Privacy and security are taken very seriously in Cloudinary. Accordingly, you represent and warrant that you will not, and will not permit any third party to:

    • 2.1 Access, tamper with, reverse engineer, or exploit any portion of the Services, its underlying infrastructure, systems, networks, or technologies, except through the interface provided by Cloudinary;
    • 2.2 Probe, scan, circumvent, or breach any security or authentication measures related to the Services;
    • 2.3 Disrupt or overload our infrastructure through unreasonable requests or automated systems (e.g., “bots”);
    • 2.4 Copy, modify, alter, or create derivative works of the Services or remove proprietary marks from the Services;
    • 2.5 Use the Services to transmit malware or engage in phishing activities;
    • 2.6 Engage in activities or upload content that harms or disrupts the Services, our systems, or any third-party infrastructure;
    • 2.7 Upload content that contains viruses, Trojans, worms, or other harmful code intended to damage or hijack any hardware, software, or telecommunications equipment;
    • 2.8 Attempt to gain unauthorized access to the Services or circumvent any software protection or monitoring mechanisms.
    • 3. Acceptable Content

      You represent and warrant that you will not, and will not permit or encourage others to upload, submit, prompt, input, transmit, broadcast, send, publish, output, collect or otherwise make available to or through the Services any content, including Contributed Content (as defined in the Terms) that:

    • 3.1 Exploits or abuses children, including images or depictions of child abuse or sexual content involving minors;
    • 3.2 Infringes on Cloudinary’s or any third party’s intellectual property rights, privacy rights, or any other rights;
    • 3.3 Is deceptive, fraudulent, illegal, obscene, defamatory, or otherwise harmful, including content that incites violence or terrorism;
    • 3.4 Promotes discrimination, hatred, or violence based on race, ethnicity, national origin, religion, gender, sexual orientation, or disability;
    • 3.5 Promotes or engages in activities that could harm or exploit vulnerable individuals, including but not limited to those with disabilities or medical conditions;
    • 3.6 Generates or uses content, including through AI functionalities, that is illegal, harmful, or infringes on third-party rights.

Cloudinary reserves the right, at its sole discretion, to determine whether specific content, when questionable, is permissible under the Terms and this AUP or constitutes a violation of the Terms.

      4. Usage Restrictions

    • 4.1 Your use of the Account is limited to the scope of use and storage permitted under your subscription plan. Note that opening multiple accounts to bypass usage restrictions and/or gain additional storage or usage across a number of accounts is similarly prohibited under this AUP.
    • 4.2 Using a third-party CDN in front of the Services without the corresponding plan and configuration is not supported. If you have independently configured a caching layer in front of the Services, in addition to any other provisions in this AUP, your Account may be suspended until migrating to a suitable subscription plan.
    • 4.3 You represent and warrant that you will not misuse the Services or use them in an excessive manner beyond the permitted scope or standard use, including consuming excessive storage or burdening our systems in a way that impairs their operation.
    • 5. Monitoring and Enforcement

      While Cloudinary is under no obligation to monitor your activities, we may, at any time and for any reason, systematically screen or monitor any content uploaded to or transmitted through our Services to ensure compliance with this AUP and the Terms.

      6. Consequences of Violations

      If you’ve seen any content or behavior that you believe is in breach of these guidelines and APU, please report to us and we will act accordingly and in proportion to the severity of the issue. Further, if we suspect that your account, content, or activities are in violation of this AUP, the Terms, or applicable law, we may take the following actions, with or without notice:

    • 6.1 Remove or block content from the Services, in whole or in part;
    • 6.2 Suspend or terminate your account or access to the Services, or to certain functionalities within the Services;
    • 6.3 Remove or limit access to content or data you have submitted or made available through the Services;
    • 6.4 Terminate or suspend affiliated accounts (e.g., accounts originating from the same domain or IP address).

Without limiting any rights granted to Cloudinary under the Terms and applicable law, it is hereby clarified suspension or termination of an Account or subscription to the Services, due to a breach or suspected breach of the Terms and this AUP, will not entitle the Account owner to any refunds, credits, or other compensation.

    7. User Responsibility for Data Backup

  • 7.1 You are solely responsible for regularly backing up your account data and content.
  • 7.2 In the event of account suspension or termination due to violations of this AUP or the Terms or otherwise at the end of your subscription term, all associated data and content may be permanently deleted. Cloudinary is not liable for any loss of data.
  • 7.3 Cloudinary may suspend, wipe and permanently delete all content, including without limitation, Contributed Content, from Accounts identified in our systems as dormant and/or inactive for an extensive period of time, with or without notice.
  • 8. Amendments to the AUP

    Cloudinary may update or amend this AUP from time to time. If material changes are made, we will notify you as appropriate (e.g., by displaying a prominent notice within the Services). Your continued use of the Services after changes have been implemented will constitute your acceptance of the updated AUP.
